Not sure what jurisdiction Federal Law has over a Chinese citizen on his own soil. I doubt customs has anything to do with an item that has not been shipped.I think they shipped the 'trinket' to fool eBay into thinking business as usual. That way the funds would supposedly be released.Never sold anything on eBay so I don't know the process.

$56.99 was returned to my bank account today and tracking says my item is now at the USPS Oakland, Ca distribution center and on it's way to the destination. The product information still describes it as 'small package'. It does not give me an estimated date of delivery.
Kerry, I am wondering how the USPS handles something like that!When we receive mail (etc.) for someone else, if it isn't junk mail, we send it back through the system.
