They have to send something so it won't be transit fraud or mail fraud. Wonder how customs handled it?

Not sure what jurisdiction Federal Law has over a Chinese citizen on his own soil. I doubt customs has anything to do with an item that has not been shipped.
I think they shipped the 'trinket' to fool eBay into thinking business as usual. That way the funds would supposedly be released.
Never sold anything on eBay so I don't know the process.

I'm not sure either, but I think this does qualify for a US Mail fraud case. I don't know if eBay will handle it that way, but I do think there are enough of us on this forum to provide evidence that it could at least be pursued.

I guess I will have to look up the legal definitions of USMail crimes/fraud... but I am too tired to do that right now.

Probably ebay will have to take a different approach since FRAUD involves "deceit/deception". It seems that there was no deception here. It was more like "I know this is probably a scam; but I am going to gamble a few dollars."

$56.99 was returned to my bank account today and tracking says my item is now at the USPS Oakland, Ca distribution center and on it's way to the destination. The product information still describes it as 'small package'. It does not give me an estimated date of delivery.

I used a CC, and $56.99 has not been credited back to my account yet.

I used a debit card attached to a small account I have set up for online purchases. My Paypal account is also linked to this account. I transfer funds in and out of this account from my checking account. It's easy to set up and I pay a $3 service fee to my bank for everything.

Kerry, I am wondering how the USPS handles something like that!
When we receive mail (etc.) for someone else, if it isn't junk mail, we send it back through the system.

Actually, I think the "seller" sent me the wrong tracking number and this may all be part of the scam to try and delay things long enough for their scam to work.

Thanks to avator WE found out pretty early on that this was a scam, so the delays didn't work.

It is also possible that I may actually receive "something" in the future, but I don't have any way to track that, so it will be a surprise when/if anything ever does come.

He offered and sold many things for $40 or more. Last time I checked his neg reports were 35 and growing in just a few days. Several scams add up quickly.
