Scope for new hw97k?

The gun will be used for mostly target and some hunting. Thinking I want to set it up for hunter class field target so 3-12x40 is the max I can have?

It appears you have some familiarity with the subject area. Just bear in mind, adjustable objective and side focus.
I can't recommend a specific scope but I like Sun, Hawke, and Leapers UTG for brands. There are better and more expensive ones out there but these seem to offer good value.

One thing I will offer, not brand specific, is to consider your reticle. If you intend to do fairly precise target shooting at varying ranges, ie field target, your choice of reticle can be important.
First thing, of course, is that you want something with fairly numerous stadia, ie a "busy" reticle, as in a mil-dot. There are full mildots, with spacing only every milliradian, some of which have all dots and some of which alternate dots with hashes. Each dot is usually .2 milliradian, so that can be a helpful guide for sub-milliradian holdovers. There are "half mil-dot" reticles that have stadia every .5 milliradian.
Going further, there are scopes with stadia spaced on minutes of angle, which will usually entail a closer spacing than a mil-dot reticle (because a milliradian is more than three moa). Personally, minutes of angle are more intuitive for me when attempting to range a target that measures in inches, but ymmv.
As you may know, minute of angle is roughly an inch at 100 yards, while a milliradian is 1 unit at 1000 units, whether the units are inches, feet, yards or meters. They are particularly adapted for ranging man-size targets at several hundred or thousand yards.
Some reticles have fewer or no stadia on the horizontal crosshair, so there's nothing for windage holdover. Maybe you want/need, maybe you don't.
You can get by with a plain ol crosshair if you want to do holdovers by clicking the elevation knob, but then the precision of your scope mechanisms come into play.
Some of this you can't figure out your preferences until you've done it a while.

I'm an idiot. I assumed that field target was a possibility because HW97, but did not read that you are considering Hunter class.
Since you can't "click" in Hunter, that redoubles the emphasis on reticle.
The other thing to consider is AO or side focus for parallax adjustment. Side focus gives you the ability to "expand" your range markings by mounting an oversize sidewheel. With AO, you are kind of stuck with the diameter of your objective bell. Some AOs have a long "range" of rotation, allowing for pretty good spacing of your range marks. A lot of good shooters used AO, but side focus is definitely a preference these days.
Also, the consensus seems to be that no scope made ranges particularly accurately past about 40 yards at 12x, so to be really competitive, "bracketing" or using your reticle to "measure" known target or cinder block dimensions to correlate to range is something arguably necessary. Again, emphasis on the reticle.
Some very good hunter shooters I know favor the Optisan Viper scope, which is no longer made. Current Optisans in the 3-12x and 4-16x class don't have a 12x marking, unbelievably, so they are useless for hunter class. Supposedly, they are coming out with another range/model that won't suffer that drawback. The Vipers were a bit more than the UTG and Hawke, but still under $500. Presumably the new models will be too. The Optisans had a busy reticle with windage "bars" below the horizontal, and, best of all, a 50mm objective, one of the keys to depth of field and good ranging.
